Woman says Allied Nursing & Community Services violated wage payment act

HUNTINGTON -- A former employee is suing Allied Nursing & Community Services after she claims it failed to pay her final wages in a timely manner.

Virginia R. Marcum was employed by the defendant from Sept. 1, 2007, until March 9, according to a complaint filed Aug. 2 in Cabell Circuit Court.

Marcum claims the defendant failed to pay her final wages within 72 hours of her discharge.

Allied Nursing's failure to pay Marcum violated the West Virginia Wage Payment and Collection Act and entitles her to liquidated damages, according to the suit.

Marcum claims the defendant's failure to pay her within 72 hours of terminating her employment is "contrary to the principles of freedom and equality of opportunity, and is destructive to a free and democratic society."

Marcum is seeking compensatory and liquidated damages. She is being represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone III.

The case has been assigned to Circuit Judge David M. Pancake.
