Logan Co. woman blames elevator company for hospital incident

CHARLESTON -- A Logan County woman is suing Abell Elevator Service Company after she claims she was injured on a defective elevator at Charleston Area Medical Center.

Charleston Area Medical Center was also named as a defendant in the suit.

Abell Elevator Service Company is doing business as Oracle Elevator Company.

On Aug. 25, 2010, Jennifer Lynn Greene was an invitee at CAMC's Memorial Division Hospital when elevator "G" suddenly free-fell from the third floor to the bottom of the elevator shaft and then returned to the first floor, according to a complaint filed Aug. 24 in Kanawha Circuit Court.

Greene claims by failing to ensure that the elevator's in the hospital were functioning property and free of dangers and hazards, the defendants were negligent, careless and reckless in the maintenance of the elevators.

The defendants failed to identify and repair hazards and unsafe conditions in the elevators so as to prevent injury to invitees at CAMC's facility, according to the suit.

Greene claims she suffered injuries as a result of the defendants' negligence and was forced to incur medical expenses for her injuries.

The defendants' actions caused Greene to suffer physical and mental pain and suffering; mental anguish; and loss of enjoyment of life, according to the suit.

Greene claims the defendants had a duty to maintain the elevators in the facility and failed to do so.

Joseph Paul Greene II, Jennifer Greene's son, has suffered the loss of parental consortium, according to the suit.

Jennifer Greene is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Troy N. Giatras.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
