CHARLESTON -- A Kanawha County man is suing the West Virginia Department of Highways after he was involved in a car accident.
Dimitri Lymon Beverly, an employee of the Department of Highways, was also named as a defendant in the suit.
On Sept. 9, 2010, Beverly was driving north on Interstate 77 in Charleston when he failed to maintain control of his vehicle by following too close and struck a vehicle being driven by William Lockhart, according to a complaint filed Aug. 24 in Kanawha Circuit Court.
Lockhart claims the collision caused permanent injuries to his hip.
Beverly breached his duty of care to Lockhart when he failed to maintain control of his vehicle and was otherwise negligent in the operation of his vehicle, according to the suit.
Lockhart claims as a result of Beverly's negligence, he injured his left hip, which has affected his range of motion and has caused him to walk with a limp.
The defendants' negligence caused Lockhart to suffer medical expenses; has permanently lost enjoyment of life to a significant degree; has lost wages; has suffered and will suffer pain in the future; and has otherwise been injured, according to the suit.
Lockhart is seeking compensatory damages. He is being represented by Henry E. Wood III.
The case has been assigned to Circuit Judge Louis H. Bloom.
