CHARLESTON -- A Dunbar woman and her husband are suing Southridge Grandprix and Family Fun Center for injuries sustained while roller skating on its premises.
On March 23, Jeannie Stewart was at Southridge and was roller skating when she attempted to avoid hitting another skater who was skating in the wrong direction, but her skate would not turn, according to a complaint filed Aug. 27 in Kanawha Circuit Court.
Stewart claims the defendant failed to maintain safe and properly fitting skates and failed to properly supervise the skaters on the floor.
The defendant 's actions were negligent in failing to maintain its equipment in a reasonably safe condition; failing to exercise due care in maintenance and inspection of the premises; failing to adequately train its personnel in the appropriate methods to direct the flow of skaters; failing to exercise due care generally; and other acts and omissions known or unknown to Stewart, according to the suit.
Stewart claims the defendant's negligence and carelessness caused her to suffer injuries to her left ankle and leg, some of which could be permanent in nature.
As a result of the defendant's negligence and carelessness, Stewart continues to suffer bodily injuries requiring medical treatment and related expenses; physical pain and suffering; mental anguish; emotional distress; a diminution in the ability to enjoy life; and lost income and wages, according to the suit.
Stewart and her husband, Ronald Stewart, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Kathy A. Brown.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
