* On Dec. 23, 2011, the Whites entered into a motor vehicle purchase contract with the defendants for the purchase of a 2012 GMC Terrain. They claim the vehicle was defective. The Whites are seeking for the contract to be canceled and compensatory and punitive damages with pre- and post-judgment interest.

* On Oct. 1, 2010, Fleshman was operating a commercial tractor trailer on U.S. 60 on Glasgow when he collided head-on with a Ford F-150 pick-up truck in which the Runnions and Holdren were passengers. The accident caused Joseph Runnion and Holdren’s deaths and injuries to Dorothy Runnion. The plaintiffs are seeking compensatory and punitive damages with pre- and post-judgment interest.

* On Oct. 20, 2010, Seaman signed a severance agreement from the defendant that provided that he would continue to receive his salary through Dec. 31, 2010, payable on Oct. 29, 2010, and that he would receive a $25,000 automobile allowance minus appropriate and required withholdings payable on Oct. 29, 2010. The defendant failed to pay Seaman’s salary and did not give him the automobile allowance. Seaman is seeking judgment in the amount equal to loss of all wages with interest, judgment against the defendant for an amount equal to loss of all accrued vacation pay with interest, liquidated damages and the $25,000 automobile allowance promised under the agreement.

He claims he also filled out forms required by Met Life for temporary leave and had his physician fill out forms regarding the temporary leave. Summers claims when he was released to return to work, his employment was terminated. Summers is seeking compensatory and punitive damages with pre- and post-judgment interest.

* On Sept. 29, 2010, Lester was assigned to operate a Caterpillar D6N bulldozer on a steep mountainside above a highwall for the purpose of pushing dirt over the highwall cliff to cover exposed rock of the highwall. Lester claims the defendants failed to adequately secure the bulldozer. As a result, the bulldozer plummeted down the steep mountainside, falling over the highwall cliff and rolling multiple times until it came to rest several hundred feet down the mountainside, according to the suit. Lester is seeking compensatory and punitive damages with pre- and post-judgment interest.

* On March 5, Brandy Messer was operating a 2011 Volvo Station Wagon when Lane, who was operating a 2005 Ford Ranger pickup truck owned by Advanced Communications, caused a vehicle accident that caused Brandy Messer to suffer injuries. The Messers are seeking compensatory damages.
