Couple sues Walls Sanitation for work injuries

MORGANTOWN -- A man and his wife are suing Walls Sanitation, Inc., after he was injured while performing his work duties.

Wayne Douglas was employed by Walls Sanitation on June 20, 2011, and as part of his work responsibilities, Douglas was required to drive a 2003 Mack dump truck on a regularly scheduled garbage pickup route, according to a complaint filed Aug. 31 in Monongalia Circuit Court.

Douglas claims the Mack dump truck was not properly maintained or inspected and was serviced routinely by an unqualified employee without proper training or qualifications, making the truck dangerous.

On June 20, 2011, while operating the Mack dump truck, Douglas suffered serious and permanent personal injuries when the cab of the truck exploded, according to the suit.

Douglas claims the workplace contained several specific unsafe working conditions, which presented a high degree of risk and a strong probability of serious injury or death.

As a result of the defendant’s actions, Douglas suffered medical related expenses, lost wages, loss of enjoyment of life, mental anguish and permanent injury, scarring and disfigurement, according to the suit.

Douglas and his wife, Carol Douglas, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Alex J. Shook and Andrew G. Meek.
