K&K Bit sues Frasure Creek Mining for failure to pay more than $250,000

WINFIELD -- K&K Bit Company is suing Frasure Creek Mining after it claims it failed to pay more than $250,000 for goods and services.

From September 2011 until February, K&K sold and delivered goods and/or services to Frasure, according to a complaint filed Sept. 6 in Putnam Circuit Court.

K&K claims Frasure has failed and refused to pay for the goods sold and delivered and/or services it provided in the amount of $251,703.28.

The goods and services were provided at Frasure’s request and failing to pay K&K what it is owed is a breach of contract, according to the suit.

K&K claims the defendant has been unjustly enriched in the amount of $251,703.28 by failing and refusing to pay for goods sold and delivered and/or services it provided.

K&K is seeking damages in the amount of $251,703.28 with pre- and post-judgment interest. It is being represented by Ryan S. Marsteller.

The case has been assigned to Circuit Judge Phillip Stowers.
