Couple blames Rumpke for car accident

HUNTINGTON – A couple is suing Rumpke Transportation Company for a car accident that caused them injuries.

Rumpke of West Virginia, Inc. and Gene E. Smith were also named as defendants in the couple’s separate suits.

On Sept. 15, 2010, Garry W. Gay was driving a 2002 Chevrolet pickup truck in which Judy S. Gay was a passenger, and was stopped in traffic on Madison Avenue in Huntington, according to two complaints filed Sept. 7 in Cabell Circuit Court.

The Gays claim a 1999 Chevrolet Blazer driven by Heather Cremeans was stopped in traffic directly behind their vehicle.

A garbage truck owned by Rumpke and driven by Smith struck the rear of the Cremeans vehicle, shoving it into the rear of the Gay vehicle, which caused the couple to sustain injuries, according to the suits.

The Gays claim Smith was negligent in driving the garbage truck.

Garry Gay suffered injuries to his back and Judy Gay suffered injuries to her neck and back, according to the suits.

The Gays are seeking compensatory damages with pre- and post-judgment interest. Garry Gay is being represented by Shawn R. Romano. Judy Gay is being represented by JB Akers.

The cases have been assigned to Circuit Judge David M. Pancake and F. Jane Hustead.
