Nitro woman sues A&A Express for car accident

HUNTINGTON – A Nitro woman is suing A&A Express, Inc. after she claims she was injured as a result of a car accident.

Daniel M. Hofer, an employee of A&A Express, was also named as a defendant in the suit.

On Oct. 7, 2010, Lindsey N. Thaxton was operating a 2000 Toyota Celica in a lawful and proper manner in the left lane of Interstate 64 near Barboursville and was passing Hofer’s tractor trailer, which was owned by A&A Express, when Hofer negligently and recklessly steered the tractor trailer into the left lane, according to a complaint filed Sept. 13 in Cabell Circuit Court.

Thaxton claims as a result of Hofer’s negligent and reckless actions, the tractor trailer struck her vehicle, causing it to proceed off of the roadway.

The collision caused Thaxton to sustain severe injuries to her body, according to the suit, and caused to suffer lost wages; medical expenses; lost educational expenses/benefits; pain and suffering; physical limitations; diminished capacity to enjoy life; and annoyance and inconvenience.

Thaxton is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Robert D. Cline Jr., Robert A. Campbell, R. Chad Duffield and Jennifer L. Dietz.

The case has been assigned to Circuit Judge David M. Pancake.
