CHARLESTON -- A Kanawha County woman is suing the Ben Franklin Career Center after she claims she was injured while on its premises.
Paula Potter, principal of Ben Franklin Career Center; John Baird, former principal of Ben Franklin Career Center; the Kanawha County Board of Education; Ronald E. Duerring, superintendent of Kanawha County Schools; and William P. Thaw, president of the Kanawha County Board of Education, were also named as defendants in the suit.
On Sept. 15, 2010, Jessica Austin slipped and fell in the restroom of the defendants’ Dunbar location and was injured, according to a complaint filed Sept. 5 in Kanawha Circuit Court.
Austin claims she walked in the restroom in a careful and prudent manner when she slipped and fell.
The defendants improperly and negligently maintained the floor of the restroom, according to the suit.
Austin claims she suffered from a broken coccyx and other physical injuries; physical and emotional pain and suffering; and incurred medical expenses.
The defendants’ negligence caused Austin to suffer a loss of enjoyment of life, emotional distress, loss of income/wages, loss of ability to engage in normal pursuits and other damages, according to the suit.
Austin is seeking compensatory damages with pre- and post-judgment interest. She is being represented by William C. Forbes and W. Jesse Forbes.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
