HUNTINGTON -- A Midkiff man is suing Hertz Corporation for injuries he suffered due to a car accident caused by someone driving one of its rental cars.
Hertz Rent A Car and Donald P. Borowski were also named as defendants in the suit.
On Aug. 5, 2011, Gregory M. Miller was test driving a 2011 Toyota Tacoma on West Virginia 13, also known as Johns Creek Road, in Milton near the underpass for Interstate 64 when he was injured due to an automobile accident involved Borowski, who was driving a Hertz rental car, according to a complaint filed Sept. 14 in Cabell Circuit Court.
Miller claims Borowski failed to yield the right of way and his sudden U-turn was illegal and his negligent behavior caused the accident.
As a result of the accident, Miller sustained substantial injuries to his neck, according to the suit.
Miller claims Hertz is liable for the damage and injuries done to him by Borowski as a contractual partner with Borowski.
Borowski’s actions in failing to yield the right of way and making an illegal U-turn caused the rental car to strike the vehicle being test driven by Miller and damaging the vehicle, as well as injuring Miller, according to the suit.
Miller is seeking judgment for damages in an amount to be determined by a jury. He is being represented by Ronald G. Salmons, Jeffrey S. Bowen and Jason A. Adkins.
The case has been assigned to Circuit Judge David M. Pancake.
