CHARLESTON -- A woman is suing Wal-mart Stores, Inc., after she was injured while shopping at its South Charleston location.
George Skinner, the general manager of the South Charleston Wal-mart, was also named as a defendant in the suit.
On Oct. 27, 2010, Marilyn Harmon was at the South Charleston Wal-mart when she slipped on a clear hanger that was in the floor and twisted her left knee, according to a complaint filed Sept. 13 in Kanawha Circuit Court.
Harmon claims the defendants exposed her to an inherently dangerous condition on its premises and failed to warn her that the dangerous condition existed on the premises.
As a result of the defendants’ negligence, Harmon was injured when her left foot slid on the hanger in the floor and caused her to twist her left knee and sustain severe and permanent damage, including a left knee sprain and left knee meniscal tear, according to the suit.
Harmon claims her sustained pain and suffering; loss of enjoyment of life; and medical expenses due to the defendants’ negligence.
The defendants were negligent in failing to abide by their duty of care not to expose Harmon to dangerous conditions on its premises, according to the suit.
Harmon is seeking compensatory damages. She is being represented by Lia DiTrapano Fairless, Elizabeth G. Kavitz and Rudolph L. DiTrapano.
The case has been assigned to Circuit Judge James C. Stucky.
