CHARLESTON -- A man is suing Select Medical Corporation after he claims it was negligent in its care of his family member.
Select Medical Holdings Corporation; Select Specialty Hospital-Charleston, Inc.; and Does One through 20 were also named as defendants in the suit.
John Terrance McDaniel was a patient of the defendants from Sept. 14, 2010, until Oct. 6, 2010, according to a complaint filed Sept. 13 in Kanawha Circuit Court.
Roy J. McDaniel claims the defendants breached their contract by failing to provide appropriate medical care to John Terrance McDaniel.
The defendants failed to provide sufficient numbers of adequately trained and supervised staff to meet John McDaniel’s needs; failed to develop and implement a care plan that was individualized to address John McDaniel’s nutrition and hydration needs; failed to develop and implement a care plan that was individualized to prevent the formation of new pressure sores and promote healing of the wounds that developed; and failed to implement adequate infection control precautions, according to the suit.
Roy McDaniel claims the defendants were negligent in caring for John McDaniel and in providing him appropriate pressure ulcer prevention care.
The defendants’ gross negligence caused John McDaniel to sustain pain and suffering; severe emotional distress; greatly increased disabilities; loss of enjoyment of life; and increased medical expenses, according to the suit.
Roy McDaniel is seeking compensatory and punitive damages. He is being represented by David R. Karr Jr.
The case has been assigned to Circuit Judge James C. Stucky.
