HUNTINGTON -- A man is suing B&R Development after he was injured in an accident while driving his motorcycle due to negligently secured cargo.
Steward Albert Asebes was also named as a defendant in the suit.
On Sept. 20, 2010, Paul Crisp was driving a motorcycle on Ohio 7 near Union Township and was following a pickup truck being driven by Asebes, according to a complaint filed Sept. 20 in Cabell Circuit Court.
Crisp claims Asebes recklessly, carelessly and negligently secured cargo into the bed of the truck and failed to properly secure the cargo, which fell out and into his path.
Asebes was employed by B&R and was acting on behalf of B&R at the time of the accident, according to the suit.
Crisp claims B&R acted recklessly, carelessly and negligently by failing to train its employees or agents in the proper method to secure cargo.
B&R’s failure to train employees in securing the cargo is the proximate cause of the cargo falling out of the vehicle and into the path of Crisp’s motorcycle, according to the suit.
Crisp claims as a result of the defendants’ negligent, careless and wanton conduct, he was caused to suffer severe and permanent injuries and great pain of body and mind.
The defendants’ actions also caused Crisp to incur expenses for doctors, hospitals, medicines, medical appliances, x-rays and other medical care and attention, according to the suit.
Crisp is seeking compensatory damages. He is being represented by Brian Alan Prim.
The case has been assigned to Circuit Judge F. Jane Hustead.
