Mine supply company didn't pay, suit alleges

HUNTINGTON -- High Performance Heat Treating, Inc., is suing H&W Mine Supply, Inc., after it claims it failed to pay more than $35,000 for services performed.

H&W Mine Supply, Inc., is also doing business as Hurley Mine Supply.

High Performance performed services for the defendant, according to a complaint filed Sept. 19 in Cabell Circuit Court.

High Performance claims H&W failed to pay for the services.

The defendant failed to pay for the services it requested and purchased from High Performance, despite High Performance making numerous demands for payment, according to the suit.

High Performance is seeking judgment in the amount of $37,212.81 with interest. It is being represented by Daniel J. Konrad.

The case has been assigned to Circuit Judge David M. Pancake.
