Former employee sues ambulance service for wrongful termination

CHARLESTON -- A former employee is suing American Ambulette & Ambulance Service, Inc., after she claims her employment was wrongfully terminated.

Tara Neal was employed by the defendant from April 1, 2009, until Aug. 12, 2011, according to a complaint filed Sept. 18 in Kanawha Circuit Court.

Neal claims her employment was terminated in violation of Medicare and Medicaid billing policies for Ambulance Services.

On Aug. 9, 2011, Neal’s supervisor instructed her to scan and upload a large stack of patient signature sheets and physician certification statements, however, she observed that they had been photocopied and the dates redacted and changed and/or contained forged signatures, according to the suit.

Neal claims she told her supervisor she refused to scan in the falsified documents because it was illegal and would be considered Medicaid and Medicare fraud.

Because she refused to scan in the documents, Neal’s supervisor instructed her to scan the documents in or go home, according to the suit.

Neal claims on Aug. 12, 2011, her employment was terminated for her refusal to participate in fraudulent billing practices, which violates public policy.

The defendant’s actions caused Neal harm, according to the suit.

Neal is seeking compensatory and punitive damages. He is being represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone III.

The case has been assigned to Circuit Judge Tod J. Kaufman.
