Raleigh Co. woman says FedEx to blame for car accident

CHARLESTON -- A Raleigh County woman is suing FedEx Freight, Inc., after she claims diesel fuel from a FedEx vehicle caused her to lose control of her vehicle.

Tony Lorenzo Ford, an employee of FedEx, was also named as a defendant in the suit.

On April 18, Ford, who was operating a 2008 Volvo tractor trailer owned by FedEx, negligently lost control of the vehicle and crashed, which caused the fuel tanks on the vehicle to rupture and blanket both lanes with diesel fuel, according to a complaint filed Oct. 1 in Kanawha Circuit Court.

Jennie Fernandez was operating her 2002 Chevrolet Trailblazer traveling south on Interstate 77 near Cabin Creek and was passing through the diesel fuel that had spilled from the tractor trailer onto the southbound interstate highway, when she lost control of her vehicle and struck another vehicle.

Fernandez claims as a result of the defendants’ negligence, she suffered serious and permanent injuries to her neck, nose, upper and lower back, left leg and left knee.

The defendants’ negligence caused Fernandez to incur medical expenses in excess of $6,800, according to the suit.

Fernandez is seeking compensatory damages. She is being represented by Kevin B. Burgess.

The case has been assigned to Circuit Judge Jennifer Bailey.
