WAYNE – A Kanawha County man is suing Blacktop Industries & Equipment Company for failing to pay more than $170,000 in debt.
On Sept. 21, 2011, Blacktop entered into a contract with Tracy Robison, who is doing business as Robison Trucking & Excavation, for the purposes of performing work, labor and materials for a project in Charleston, according to a complaint filed Oct. 5 in Wayne Circuit Court.
Robison claims he performed the work for the project in a timely manner and in a workmanlike fashion, and issued invoices for services performed in the amount of $169,081.71 to the defendant.
Blacktop has made no payment to Robison, leaving the full balance of the invoices unpaid, according to the suit.
On Sept. 7, 2011, Blacktop entered into another contract with Robison to perform flagging work, according to the suit, and on Dec. 15, 2011, Robison issued an invoice for the flagging services performed in the amount of $15,759.
Robison claims the defendant has only issued payment in the amount of $13,390, leaving an unpaid balance of $2,369.
The defendant’s actions are a breach of contract and have caused Robison to suffer damages in the amount of $171,450.71.
Robinson is seeking compensatory damages. He is being represented by Michael A. Olivio and Travis A. Griffith.
The case has been assigned to Circuit Judge James H. Young Jr.
