Woman sues Canyon Sudar Partners claiming nursing home negligence

HUNTINGTON -- A woman is suing Canyon Sudar Partners, LLC, after she claims they negligently cared for her family member.

SVCare Holdings, LLC; Sava Senior Care, LLC; SSC Equity Holdings, LLC; SMV Management Company, LLC; SMV Huntington, LLC; Annica Stansberry; John Does 1 through 10; and Unidentified Entities 1 through 10 (as to Huntington Health & Rehabilitation) were also named as defendants in the suit.

Ann Barcheck was admitted to Huntington Health & Rehabilitation and was a resident there from Oct. 27, 2010, until March 15, according to a complaint filed Oct. 10 in Cabell Circuit Court.

Pamela Renne claims the defendants caused Barcheck’s health to deteriorate beyond that caused by the normal aging process.

The defendants failed to discharge their obligations of care to Barcheck and, as a consequence, she suffered catastrophic injuries, disfigurement, extreme pain, suffering and mental anguish, according to the suit.

Renne claims the defendants alleged negligence caused Barcheck physical and emotional trauma, including falls, infections and fractures.

The defendants are accused of breaching their duty of care by failing to properly manage, operate and/or control the nursing home in a manner that a reasonably careful person/corporation would have provided under similar circumstances, according to the suit.

Renne claims Barcheck suffered injuries, extreme pain, suffering, mental anguish, embarrassment, disfigurement and fright, all of which required hospitalization and medical treatment, as a result of the defendants’ failure to perform their responsibilities.

The defendants also allegedly used deception, false pretense, false promises and/or misrepresentations and/or the concealment, suppression and/or omission of material facts with the intent that Barcheck and others rely upon such concealment, suppression or omission, in connections with the same of nursing home services, according to the suit.

Renne is seeking compensatory and punitive damages. She is being represented by James B. McHugh, Michael J. Fuller Jr. and D. Bryant Chaffin.

The case has been assigned to Circuit Judge F. Jane Hustead.
