WINFIELD – A Hurricane woman is suing Wal-Mart Stores East, LP after she says she was injured while shopping in one of its stores.
On July 9, 2011, Roberta Marazo was shopping at the Hurricane Wal-Mart when she tripped over a protruding pallet, which was supporting produce, and fell violently to the floor and was injured, according to a complaint filed Nov. 5 in Putnam Circuit Court.
Marazo claims Wal-Mart failed to maintain the floor of the store in a reasonably safe condition and failed to warn her of the danger presented by the presence of the protruding pallet.
Wal-Mart also failed to warn Marazo that a fall hazard was presented by the presence of the protruding pallet and negligently failed to place warning and tripping hazard signs to alert patrons of the pallet, according to the suit.
Marazo claims she suffered serious injuries to her face, back and neck because of the fall over the protruding pallet.
The defendant failed to exercise due care and was negligent, according to the suit.
Marazo is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Jon D. Hoover.
The case has been assigned to Circuit Judge Phillip M. Stowers.
