Woman sues Huntington Health & Rehab for mother's death

HUNTINGTON – A woman is suing Seventeenth Street Associates, LLC after she claims it failed to care for her mother.

Seventeenth Street Associates, LLC, is doing business as Huntington Health and Rehabilitation Center.

Arline Baumgardner was a nursing home resident of the defendant from July 21, 2011, until Sept. 5, 2011, according to a complaint filed Nov. 13 in Cabell Circuit Court.

Pamela S. Ferguson claims while Baumgardner was in the nursing home’s care, she developed urinary tract infections and suffered multiple falls.

The defendant failed to provide Baumgardner with additional interventions to prevent the multiple falls and failed to provide adequate hygiene to prevent the development of infection, according to the suit.

Ferguson claims the defendant’s negligence and carelessness substantially caused Baumgardner’s injuries, which resulted in pain, suffering, a decline in her overall status and ultimately, her death on Sept. 15, 2011.

As a result of the defendant’s negligence, Ferguson has incurred medical expenses for the care and treatment of the conditions that led to Baumgardner’s death and the estate has incurred funeral expenses, according to the suit.

Ferguson is seeking compensatory and punitive damages. She is being represented by Andrew L. Paternostro and Jeff D. Stewart.

The case has been assigned to Circuit Judge David M. Pancake.
