HUNTINGTON – Parker Compound Bows, Inc., is suing Outback Archery, Inc., after it claims the company has failed to pay for goods and services.
Christopher A. Messinger, an employee of the defendant, was also named as a defendant in the suit.
On Dec. 6, 2009, the defendants executed an application with Parker for the extension of credit, according to a complaint filed Nov. 15 in Cabell Circuit Court.
Parker claims as part of the application, the defendants agreed to pay invoices on net 30 terms, incur monthly service charges of 18 percent per annum on any past due balances and pay collection costs and expenses.
Messinger personally guaranteed the debt owed by Outback Archery, according to the suit.
Parker claims the defendants have failed and refused to pay for goods sold and delivered and/or services provided and it is owed the principal sum of $5,037.64, plus interest in the amount of $806.08.
Pursuant to the agreement between Parker and the defendants, the defendants have breached the terms of the agreement by failing and refusing to pay for the goods sold and delivered and/or services provided, according to the suit.
Parker claims the defendants have been unjustly enriched in the amount of $5,843.72 by failing and refusing to pay for goods sold and delivered.
Parker is seeking judgment in the amount of $5,843.72 with pre- and post-judgment interest. It is being represented by Ryan S. Marsteller.
The case has been assigned to Circuit Judge F. Jane Hustead.
