Man blames Mid-Eastern Construction for work-related injuries

HUNTINGTON – A Cabell County man is suing Mid-Eastern Construction after he claims he was injured while performing his work duties.

On Nov. 11, 2010, Gabriel Reyes was performing his work duties as a construction worker on the site of a residential construction job near Lavalette, when he was exposed to an unsafe working condition, according to a complaint filed Nov. 8 in Cabell Circuit Court.

Reyes claims while working on the construction job, he was instructed to engage and/or work in an unsafe, improper and dangerous condition and/or caused him to work with defective, improper and/or inadequate tools and/or equipment and/or training and supervision, knowing that such employment activities and/or duties were unsafe.

The defendant was negligent in placing Reyes and another employee on a roof approximately 30 feet in the air without proper safety or fall protection, according to the suit.

Reyes claims the defendant knowingly exposed him to an unsafe working condition, which caused him to suffer serious injuries.

Mid-Eastern Construction’s negligence caused Reyes to suffer serious personal injuries of a permanent and indefinite duration; physical and mental pain and suffering; loss of enjoyment of life; loss of capacity to earn an income and perform household and other related duties; medical expenses; and annoyance, inconvenience, embarrassment and humiliation, according to the suit.

Reyes is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Kenneth P. Hicks.

The case has been assigned to Circuit Judge David M. Pancake.
