Woman sues Mylan for discrimination

MORGANTOWN -- A woman is suing Mylan, Inc., for discriminating against her because of her race and in retaliation for her filing a discrimination claim with the West Virginia Human Rights Commission.

Mylan Bertek Pharmaceuticals, Inc., was also named as a defendant in the suit.

On March 25, 2002, Deborah A. Dooley was hired by the defendants as a tablet inspector and in April 2002, her employment was terminated allegedly because she had violated the nepotism policy by failing to disclose that her brother-in-law worked for Mylan, according to a complaint filed in Monongalia Circuit Court.

Dooley claims she was later reinstated and performed her duties in a satisfactory and/or above satisfactory manner.

On Sept. 14, 2011, Dooley filed a complaint with the West Virginia Human Rights Commission and since filing the complaint, she has been subjected to repeated harassment and retaliatory behavior by the defendants and/or other representatives, employees and/or agents of the defendants, according to the suit.

Dooley claims on Aug. 29, the West Virginia Human Rights Commission issued a final determination and dismissal order, as well as a notice of her right to sue.

“Plaintiff was treated in a disparate manner based at least in part upon her race and/or religious beliefs” including being prevented from performing her job duties, reprimands and off-color jokes and/or remarks by the agents and/or employees of the defendants, according to the suit.

Dooley claims the defendants had actual and/or constructive knowledge of the disparate treatment and acquiesced in and/or failed to take action to remedy the treatment.

The defendants’ actions violated the West Virginia Human Rights Act, according to the suit, and caused Dooley to suffer damages.

Dooley is seeking compensatory and punitive damages. She is being represented by Erika Klie Kolenich and D. Geoff Varney.
