Man blames Penn Station Subs for injuries

HUNTINGTON -- A man is suing Penn Station East Coast Subs after he fell and became injured while in its Huntington restaurant.

Venture, LLC, is doing business as Penn Station East Coast Subs.

On Dec. 21, 2010, Eddie Napier was proceeding to leave Penn Station when he slipped and fell on food in the floor and was injured, according to a complaint filed Nov. 20 in Cabell Circuit Court.

Napier claims he sustained multiple severe and permanent injuries as a result of the fall.

Penn Station had a duty to supervise the actions and conduct of its agents, servants, employees, representatives and/or assigns and to safeguard the general public to protect them from any harm, according to the suit.

Napier claims the defendant also named an obligation to properly maintain the restaurant premises, which it failed to do.

The defendant failed to inspect its premises; failed to discover and remove and/or repair dangerous and defective conditions of the floor; failed to provide reasonable and adequate maintenance to the premises; and failed to warm the public of any hazards and/or dangerous conditions of the floor, according to the suit.

Napier is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Kenneth P. Hicks.

The case has been assigned to Circuit Judge F. Jane Hustead.
