Man says Homestead Construction negligently installed roof

HUNTINGTON – A Barboursville man is suing Homestead Construction after he claims it negligently installed a roof on his residence.

Paul Kazee is doing business as Homestead Construction.

In April 2011, Jonathan Houck hired Kazee to install a roof on his home in Barboursville, according to a complaint filed Nov. 21 in Cabell Circuit Court.

Houck claims Kazee negligently, carelessly and improperly installed the roof and caused water and moisture damage to the walls, dry wall, floors and insulation.

Kazee breached the implied and express warranty that the roof would be constructed in a proper and workmanlike manner, according to the suit.

Houck claims as a result of Kazee’s breach of warranty, he suffered damages, including the cost of repair, the cost of replacement, the cost of his labor, the cost of materials, inconvenience, the costs of delay in construction, the diminution in the value of the property and other damages.

The negligence, carelessness and lack of skill of Kazee also required Houck to spend hours replacing and repairing the damaged areas of his home and to incur great expense to repair and replace the damaged areas of the home, according to the suit.

Houck is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Joseph M. Farrell Jr.

The case has been assigned to Circuit Judge David M. Pancake.
