Woman blames Yellow Cab for car accident

HUNTINGTON – An Ashland, Ky., woman is suing Yellow Cab after she was allegedly injured in a car accident caused by one of its employees.

Taxi Service, Inc., is doing business as Yellow Cab. Irene Abbott, also known as Irene Dean, an employee of Yellow Cab, was also named as a defendant in the suit.

On Nov. 23, 2010, Amanda S. Davis was operating a 2001 Pontiac Grand Am in Huntington when Abbott, who was operating a 2001 Ford Crown Victoria owned by the defendant, attempted to make an “ill advised U-turn on 9th Street” and collided with Davis’ vehicle, according to a complaint filed Nov. 21 in Cabell Circuit Court.

Davis claims Abbott had a duty to exercise reasonable care in the operation of the vehicle, but breached that duty when she failed to operate the vehicle in a safe and reasonable manner.

As a result of the defendants’ breach of duty and reckless and negligent conduct, Davis was caused to be injured and sustained physical and mental pain and suffering; diminution of her capacity to enjoy life; annoyance and inconvenience; has incurred expenses for medical treatment and hospital care; and other consequential damages, according to the suit.

Davis claims Yellow Cab had a duty to supervise the actions and conduct of its agents, servants, employees, representatives and/or assigns and to safeguard its patrons and the general public to protect them from any harm that might be caused by its employees.

Yellow Cab was negligent in its hiring, retention, employment and training of Abbott, according to the suit, and is vicariously liable for her tortuous acts which occurred during the normal scope of her employment.

Davis is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Timothy L. Eves.

The case has been assigned to Circuit Judge David M. Pancake.
