Suit says Frasure Creek Mining did not pay $10K

WINFIELD – North American Battery Systems, Inc., is suing Frasure Creek Mining for allegedly failing to pay more than $10,000 for goods and services.

Frasure Creek Mining, LLC, is doing business as Trinity Coal Company. From October 2011 until January, North American sold and delivered goods and/or provided services to the defendant, according to a complaint filed Nov. 29 in Putnam Circuit Court.

North American claims Frasure Creek has failed and refused to pay for the goods sold and delivered and/or the services provided in the amount of $10,351.20.

Frasure Creek breached its contract with North American by failing and refusing to pay for the goods sold and delivered and/or services provided, according to the suit.

North American claims Frasure Creek has been unjustly enriched at its expense by failing and refusing to pay.

North American is seeking damages in the amount of $10,351.20 with pre- and post-judgment interest. It is being represented by Ryan S. Marsteller.

The case has been assigned to Circuit Judge Phillip Stowers.
