CHARLESTON – A man is suing Dohm Cycles, Inc., claiming the vehicle he purchased was defective.
On Sept. 30, 2011, Michael Cantley purchased a 2011 Qlink RD500-R from Dohm Cycles, according to a complaint filed Nov. 26 in Kanawha Circuit Court.
Cantley claims he was told by representatives of Dohm that the vehicle came with a one-year dealer/manufacturer warranty and that Dohm would repair any problems he had with the vehicle.
After purchasing the vehicle, Cantley discovered and experienced several nonconformities that substantially impaired the use, value and/or safety of the vehicle, according to the suit, and returned the UTV to Dohm for various failing parks and engine problems.
Cantley claims Dohm has made some repairs, but the repairs have taken many months and the UTV has been at Dohm for more than four months since he purchased it.
If Cantley had known the defendant would not be able to perform the needed repairs, he would not have purchased the UTV, according to the suit.
Cantley claims he was also charged for GAP insurance without his knowledge and consent and did not receive any documentation on the GAP insurance.
The defendant’s actions have caused Cantley to suffer monetary loss; emotional and mental distress; loss of use; aggravation; anxiety; and annoyance and inconvenience, according to the suit.
Cantley is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Kristina Thomas Whiteaker and David L. Grubb.
The case has been assigned to Circuit Judge Tod J. Kaufman.
