Anderson claims they left the Cold Spot visibly intoxicated and went to a nearby Go-Mart. At the Go-Mart, Anderson exited the vehicle to check something under the hood when Carte, who had been sitting in the middle of the seat, and slid over into the driver seat and depressed the gas pedal, which struck Anderson, the lawsuit says. He claims the female bartender owed a duty to refrain from selling alcohol to any person visibly or noticeably intoxicated. Anderson is seeking compensatory damages with pre- and post-judgment interest.
