Potesta sues Stoneridge, NES for alleged failure to pay

CHARLESTON - Potesta & Associates, Inc., is suing Stoneridge Homes, Inc., and NES Unlimited, Inc., for failing to pay for services rendered.

On April 12 and April 26, Stoneridge promised to pay Potesta $14,686.17 by Oct. 31 for Potesta providing engineering, testing and related services, according to a complaint filed Dec. 4 in Kanawha Circuit Court.

Potesta claims the defendants have failed to pay for the services, despite demanding for payment of the balance due.

On May 11, Potesta provided additional services to Stoneridge in the amounts of $470 and $600, according to the suit, but Stoneridge has failed and refused to pay.

Potesta claims on April 12 and April 26, NES promised to pay Potesta $10,169.91 for services rendered, but has failed and refused to pay the amount owed.

Stoneridge and NES breached their contracts with Potesta and caused Potesta damages, according to the suit.

Potesta is seeking damages from Stoneridge in the amount of $15,756.17 with pre- and post-judgment interest and $10,169.91 with pre- and post-judgment interest from NES. It is being represented by Webster J. Arceneaux and Spencer D. Elliott.

The case has been assigned to Circuit Judge Jennifer Bailey.
