CHARLESTON – A Charleston man is suing Paul White Chevrolet, Inc., after he claims he fell in a parking lot owned and maintained by the company.
On Dec. 12, 2010, Lester Haynes went to the VA Clinic for a doctor’s appointment and when he exited the clinic, he slipped on an icy and/or snowy area and fell, according to a complaint filed Dec. 5 in Kanawha Circuit Court.
Haynes claims Paul White Chevrolet owned the property and leased it to another business.
As a result of the defendant’s negligence and/or carelessness, Haynes sustained severe trauma to his right leg and general abrasions and contusions to other parts of his body, according to the suit.
Haynes claims he suffered severe physical and mental pain and anguish; physical and mental pain and discomfort; grain pain and anguish of body and mind; and loss of good health and loss of enjoyment of life.
Paul White Chevrolet failed to properly maintain the area; failed to recognize that the area was slipper and wet as a result of not properly clearing ice and show; and failed to warn patrons of the hazardous conditions, according to the suit.
Haynes is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Richard E. Hardison Jr.
The case has been assigned to Circuit Judge Carrie Webster.
