Couple sues Breof, alleges it failed to maintain parking garage

CHARLESTON – A Malden couple is suing Breof Asset Management, LLC, for alleged injuries sustained in a parking garage.

Breof BNK Midwest, LLC and Breof BNK2 Midwest, LLC, were also named as defendants in the suit.

On Dec. 3, 2010, Tammy Lipscomb parked her vehicle in the defendants’ parking garage and began to walk to her employment at Dixon, Hughes, Goodman LLP, located in Chase Tower, according to a complaint filed Nov. 30 in Kanawha Circuit Court.

Lipscomb claims the parking garage was dimly and poorly lit and the floor was in serious disrepair with potholes and cracked and broken concrete.

While walking to her place of employment through the parking garage, Lipscomb stepped in a pothole and fell onto the concrete floor, according to the suit, which caused her significant injuries and damages.

Lipscomb claims the defendants were negligent in keeping the parking garage safe.

The defendants failed to examine the premises for unsafe or dangerous conditions; failed to warn and protect its business invitees; failed to correct any unsafe or dangerous conditions; and otherwise failed to keep and maintain the premises in a safe and reasonable condition, according to the suit.

Lipscomb and her husband, Bobby Franklin Lipscomb, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Richard A. Monahan.

The case has been assigned to Circuit Judge Jennifer Bailey.
