Woman sues Trademark Exteriors, alleges hit-and-run accident

HUNTINGTON – A Cabell County woman is suing Trademark Exteriors, LLC, after she claims she was injured in a car accident caused by of one of its employees, who then fled the scene of the accident.

Bradley Shirk and Steven Lapp were also named as defendants in the suit.

On Dec. 6, 2010, Carolyn Bevans was operating her 1994 Ford Aspire on John’s Creek Road in Milton when Shirk, who was operating a 2004 GMC Truck and trailer owned by Trademark, failed to maintain control of the vehicle and collided with Bevans, according to a complaint filed Dec. 5 in Cabell Circuit Court.

Bevans claims as a result of the impact and collision, she sustained personal injuries and damage to her vehicle.

Following the collision, Shirk was under a duty to stop and render aid and information, as is required of a driver lawfully operating a vehicle and having just been involved in a motor vehicle accident, however, Shirk left the scene of the accident and proceeded on toward Interstate-64, according to the suit.

Bevans claims Shirk’s failure to control the vehicle and failure to remain at the scene of the collision violated West Virginia statutes and West Virginia code.

The defendants’ actions caused Bevans to suffer great pain of body and mind and incur medical expenses, according to the suit.

Bevans is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Paul A. Ryker.

The case has been assigned to Circuit Judge David M. Pancake.
