CHARLESTON – A former employee is suing the West Virginia Department of Health and Human Resources after she claims it violated the West Virginia Wage Payment and Collection Act.
Robin Carnell was employed by the defendant until she resigned on July 26, according to a complaint filed Dec. 28 in Kanawha Circuit Court.
Carnell claims the defendant had a duty to pay her employment wages by her next regular payday, but failed to do so.
The defendant’s actions violated the West Virginia Wage Payment and Collection Act and caused Carnell damages, according to the suit.
Carnell claims the defendant’s actions breached its duty to her by failing to pay her final wages until July 31.
WVDHHR’s actions and violations entitle Carnell to treble damages, according to the suit.
Carnell is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Jennifer Bailey.
