Logan Corporation says DFM Coal owes more than $160K

HUNTINGTON – Logan Corporation is suing DFM Coal, LLC, for allegedly failing and refusing to pay more than $160,000 for goods and services.

Yong Liu has also been named as a defendant in the suit.

On Aug. 26, 2011, DFM applied for credit with Logan, according to a complaint filed Dec. 21 in Cabell Circuit Court.

Logan claims as of June 25, the defendants have failed and refused to pay $161.213.90 plus service charges.

The credit application of DFM was guaranteed by Liu, according to the suit.

Logan claims the defendants agreed to pay all amounts due within 30 days from the date of the invoices, but have not done so.

The defendants have not paid the amounts due in a timely manner, despite Logan’s repeated demands for payment, according to the suit.

Logan is seeking money damages in the amount of $161,213.90 plus monthly service charges. It is being represented by Janet Smith Holbrook.

The case has been assigned to Circuit Judge David M. Pancake.
