CHARLESTON – A former employee is suing Sentinel Transportation, LLC, alleging that it wrongfully terminated his employment after he filed a workers’ compensation claim.
Mickey Alexander, an employee of Sentinel, was also named as a defendant in the suit.
Jerry Cowan was employed by Sentinel from Feb. 1, 2002, until Sept. 12, according to a complaint filed Jan. 14 in Kanawha Circuit Court.
Cowan claims the defendants discriminated against him because he filed a workers’ compensation claim and because of his age.
The defendants’ actions violated the West Virginia Human Rights Act, according to the suit.
Cowan claims the defendants’ actions entitle him to reinstatement to his former employment or front pay in lieu of reinstatement for the loss of future income and other employment-related benefits.
As a result of the defendants’ discharge of Cowan in violation of the West Virginia Human Rights Act, Cowan is also entitled to back pay and an award for emotional distress, embarrassment and mental anguish, according to the suit.
Cowan is seeking compensatory and punitive damages. He is being represented by J. Michael Ranson, Cynthia M. Ranson, George B. Morrone III and G. Patrick Jacobs.
The case has been assigned to Circuit Judge James C. Stucky.
