Man blames company for armored car accident

CHARLESTON – A man is suing Loomis Armored US for a car accident he claims was caused by Loomis’ failure to properly maintain its vehicles.

Loomis Armored US, LLC is doing business as Loomis, Fargo & Co.

On May 8, Charles T. Wolfe III was working for Loomis and was riding as a passenger in a 2006 white armored international truck when the driver cost control on a wet highway and caused the vehicle to flip over and roll onto its top, according to a complaint filed Jan. 17 in Kanawha Circuit Court.

Wolfe claims the investigating officer noted in the accident report that the truck’s rear tires were bald and had little to no tread left.

Prior to the accident, Wolfe had complained to Loomis about the condition of the tires on the truck, as he was extremely concerned about the safety of the vehicle, according to the suit.

Wolfe claims the driver of the truck also reported afterward to the investigating officer that he knew about the condition of the tires.

As a result of the accident, Wolfe suffered severe mental and physical injuries, including physical injuries to his neck, chest, ribs, left foot, left knee, hip, shoulder and back, according to the suit.

Wolfe claims the armored vehicle was intentionally not maintained properly by Loomis and the failure to properly maintain the vehicle was the direct and proximate cause of the accident.

Loomis intentionally exposed Wolfe to specific unsafe working conditions and caused him to suffer serious injuries, according to the suit.

Wolfe is seeking compensatory damages. He is being represented by Janet C. Stebbins.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
