JB Hunt Transport Services blamed for car accident

WINFIELD – A couple are suing JB Hunt Transport Services, Inc., after they claim it is responsible for a car accident.

Jeffrey Followell, an employee of JB Hunt, was also named as a defendant in the suit.

On Feb. 16, 2011, Wanda Dailey was injured in a car accident caused by Followell, who was operating a tractor trailer owned by JB Hunt, according to a complaint filed Jan. 18 in Putnam Circuit Court.

Dailey claims Followell negligently, carelessly and recklessly drove the tractor trailer and slammed it into her vehicle.

Followell was acting within the scope of his employment at the time of the accident, which makes JB Hunt vicariously liable for the negligent, careless and reckless driving of its employee, according to the suit.

Dailey claims as a result of the defendants’ actions, she suffered permanent injuries to her neck, back and other parts of her body; incurred pain and discomfort; suffered annoyance and inconvenience; and suffered a diminished ability to enjoy life.

As a result of the injuries Dailey suffered, her husband, Jack Dailey, incurred a loss of companionship, affections, consortium and other attributes of their marriage, according to the suit.

The Daileys are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by James R. Fox.
