HUNTINGTON – T&C Drywall, Inc., is suing Tri State Hotels, LLC, for failing to pay for drywall and labor it provided for its Holiday Inn Express project.
T&C Drywall and the defendant entered into a contract whereby T&C was to provide drywall, labor and certain extras at the defendant’s project at the Holiday Inn Express in Cross Lanes, according to a complaint filed Jan. 18 in Cabell Circuit Court.
T&C claims Tri State Hotels has failed and refused to pay for the services it provided.
The plaintiff completed the contract with a balance due and owing from the defendant in the sum of $16,220, according to the suit.
T&C claims despite repeated requests for payment, Tri State Hotels has failed and refused to pay for the goods and services provided.
The defendant’s actions are a breach of contract and have caused T&C damages, according to the suit.
T&C is seeking damages in the amount of $16,220 with interest. It is being represented by William T. Watson.
The case has been assigned to Circuit Judge David M. Pancake.
