CHARLESTON – The City of Charleston is being sued for a car accident allegedly caused by a police officer.
Eva Robinson and the Charleston Police Department were also named as defendants in the suit.
On May 18, 2011, Robin Moss was stopped at the intersection of Court Street and Smith Street in Charleston when Robinson, an employee of Charleston and the police department, rear-ended her vehicle, according to a complaint filed Jan. 11 in Kanawha Circuit Court.
Moss claims Robinson failed to maintain control of her vehicle and caused her to suffer injuries.
As a result of the defendants’ negligence, Moss received temporary and permanent injuries; suffered pain and suffering and mental anguish; suffered loss of wages; suffered a loss of enjoyment of life; and was otherwise damaged, according to the suit.
Moss and her husband, Teddy Joe Martin, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Richard M. Monahan.
The case has been assigned to Circuit Judge James C. Stucky.
