CHARLESTON – A motorcyclist is suing the physician he claims caused him injuries sustained in a car accident.
Dr. Cyrus J. Mali and Cyrus J. Mali MD, Inc., were named as defendants in the suit.
On Jan. 5, Christopher J. Bukant was operating his Harley Davison motorcycle and was traveling south-bound on W.Va. 119 in Charleston when Mali failed to yield the right of way to him and crashed his SUV into his motorcycle, according to a complaint filed Jan. 23 in Kanawha Circuit Court.
Bukant claims Mali was acting within the scope of his employment at the time of the accident.
The impact caused Bukant to be thrown from his motorcycle several feet through the air and then violently to the ground, according to the suit.
Bukant claims the impact futher caused his left leg to be amputated, as well as other serious injuries.
As a direct result of the defendants’ negligence and carelessness, Bukant suffered injuries; incurred medical expenses; was required to undergo extensive medical treatment and will continue to do so in the future; has endured pain and suffering; has sustained an impairment of the capacity to enjoy life; and has suffered annoyance, inconvenience and mental anguish, according to the suit.
Bukant is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Robert B. Warner and Truman C. Griffith.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
