Wayne couple claim Glockner misrepresented vehicle

WAYNE – Glockner is being sued after a Wayne couple claim the vehicle they purchased had issues they were not informed about.

Auto Now Acceptance Company, LLC, was also named as a defendant in the suit.

Mark Tomblin and Amy Tomblin purchased a 2005 Ford Freestar from the defendants, according to a complaint filed Jan. 18 in Wayne Circuit Court.

The Tomblins claim the defendants stated the vehicle had one previous owner and was well maintained and safe to own.

The defendants also produced a Carfax report on the vehicle, leading the Tomblins to believe the vehicle was safe, according to the suit.

The Tomblins claim they later discovered the Carfax report was not the one for the vehicle they had purchased.

After the purchase, the Tomblins discovered the vehicle had been in an accident, had numerous previous owners, had been reposed twice and had a junk title, according to the suit.

The Tomblins claim they had to replace the catalytic converters because the ones of the vehicle were “hollow tubs.”

The vehicle’s transmission also needed to be replaced and the computer showing the mileage was incorrect, according to the suit.

The Tomblins claim they later discovered the vehicle had been in a previous accident, had been repossessed twice and had a “junk title.”

The Tomblins are seeking for the defendants to reimburse them the sum of $7,000 for repairs to the vehicle, for the court to order the defendants to renegotiate a reasonable amount and payment for the vehicle and for punitive damages. They are representing themselves.

The case has been assigned to Circuit Judge Darrell Pratt.
