WINFIELD – Indiana Heat Transfer Corp. is suing Clark Truck Parts Inc. for allegedly failing and refusing to pay for goods that were delivered in 2010.
In September 2010, Indiana sold and delivered goods to the defendant at Clark’s request, according to a complaint filed Jan. 24 in Putnam Circuit Court.
Indiana claims Clark failed and refused to pay for the goods sold and delivered.
Clark breached its contract with Indiana by failing and refusing to pay for goods sold and delivered, according to the suit.
Indiana claims Clark has been unjustly enriched at its expense.
Clark has caused Indiana damages by breaching the terms of the agreement between the two parties, according to the suit.
Indiana is seeking damages in the amount of $24,692.94 with pre- and post-judgment interest. It is being represented by Ryan S. Marsteller.
The case has been assigned to Circuit Judge Joseph Reeder.
