FleetOne sues England Enterprises for breach of contract

WINFIELD – FleetOne is suing England Enterprises Inc. after it claims it failed to pay for goods sold and delivered.

F. Scott England was also named as a defendant in the suit.

On Jan. 26, 2006, the defendants executed and delivered an application for credit to FleetOne, according to a complaint filed Feb. 5 in Putnam Circuit Court.

FleetOne claims at the special instance and request of the defendants, it sold and delivered certain goods, wares and merchandise to England Enterprises.

England received and accepted the goods, wares and merchandise and agreed to pay, but as of March 31, the defendants have failed to pay the remaining balance in the account, according to the suit.

FleetOne claims the prices it charged were the prices England agreed to pay and by failing and refusing to pay, England has caused damages.

The defendants have failed and refused to pay the remaining balance, despite repeated requests from FleetOne, according to the suit.

FleetOne is seeking damages in the amount of $12,929.87 with interest. It is being represented by Robert S. Bernstein.

The case has been assigned to Circuit Judge Joseph Reeder.
