CHARLESTON – A woman is suing Wells Fargo Financial West Virginia Inc. after she claims it violated West Virginia code by continuing to contact her after she was being represented by counsel.
On June 22, 2007, Stephanie A. Bego and her former husband were refinanced by the defendant for a bank loan with BB&T, according to a complaint filed Feb. 1 in Kanawha Circuit Court.
Bego claims the defendant was the servicer of the alleged debt and on Oct. 14, 2010, she notified the defendant that she was being represented by counsel and directed all correspondence to her counsel.
On Jan. 31, 2011, Bego asserted claims through her attorney regarding the loan transaction, including those arising out of the appraisal that was completed at the time of and in conjunction with the origination of the debt, according to the suit.
Bego claims the claims were set forth in a complaint in Kanawha Circuit Court and the defendant received the complaint and filed its answer.
While she was being represented by counsel, Wells Fargo began contacting Bego directed about an alleged indebtedness seeking to collect and it has continued to do so during the pendency of the action, according to the suit.
Bego claims the defendant’s actions violated West Virginia code.
Wells Fargo also added charges to the account that were not authorized by the agreement or law and, in attempting to collect a debt, misrepresented the amount of a claim against Bego, according to the suit.
Bego is seeking actual damages and civil penalties. She is being represented by Daniel F. Hedges.
The case has been assigned to Circuit Judge Charles E. King.
