O’Neal Steel says U.S. Equipment Distributors owes more than $300K

HUNTINGTON – O’Neal Steel Inc. is suing U.S. Equipment Distributors for failing and refusing to pay for more than $300,000 owed for materials.

U.S.E.D. Inc. is doing business as U.S. Equipment Distributors.

From Aug. 9 until Nov. 8, O’Neal sold goods to the defendant in the amount of $304,121.55, according to a complaint filed Feb. 6 in Cabell Circuit Court.

O’Neal claims the defendant has failed and refused to pay for the materials.

The defendant’s actions are a breach of contract and have caused O’Neal to suffer damages, according to the suit.

O’Neal claims the defendant has been unjustly enriched at its expense.

O’Neal is seeking judgment in the amount of $304,121.55 with interest at the rate of 18 percent per annum. It is being represented by Arnold J. Janicker and Sarah Walling.

The case has been assigned to Circuit Judge David M. Pancake.
