Former employee says Harrell Memorial discriminated against him

CHARLESTON – A former employee is blaming Harrell Memorial Nursing Home, Inc., terminated his employment because of his age.

Harrell is doing business as Meadowbrook Acres Nursing Center.

Jeffrey A. Smith was also named as a defendant in the suit.

Rick Woodfell was employed by the defendants from 2005 until June 29, according to a complaint filed Feb. 7 in Kanawha Circuit Court.

Woodfell claims during his employment, the defendants subjected him and other co-workers to age discrimination “unreasonably interfering with their work performance and which created an intimidating, hostile or offensive working environment.”

The defendants also tolerated age discriminated perpetrated against Woodfell, according to the suit.

Woodfell claims the defendants violated the West Virginia Human Rights Act by discriminating against him because of his age.

The defendants falsely alleged that Woodfell was discharged for a violation of company policy when part or all of their motivation for discharging him was because of his age, according to the suit.

Woodfell is seeking compensatory and punitive damages. He is being represented by John Einreinhofer.

The case has been assigned to Circuit Judge Charles E. King.
