* Seabolt purchased a universal life insurance policy through Peoples Security Insurance in 1986 and in 1998, the policy was transferred to Monumental. After Seabolt’s death, it is alleged that the defendants terminated the policy four months before, despite assurances that it would not be terminated. The plaintiffs are seeking compensatory and punitive damages.

* On Feb. 12, 2009, Cummings instituted a civil action against JPMorgan Chase and pursuant to the terms of the settlement agreement on April 26, 2011, a stipulated order of dismissal with prejudice was entered setting forth the terms of the settlement. Cummings claims thereafter, the defendants failed to apply payments to her loan. Cummings is seeking actual damages and civil penalties.

* On June 22, 2007, Bego and her former husband had a bank loan refinanced by the defendant. Bego claims the defendant was the servicer of the alleged debt and on Oct. 14, 2010, she notified the defendant that she was being represented by counsel and directed all correspondence to her counsel. Wells Fargo communicated with Bego knowing she was being represented by counsel, which violates West Virginia code, the suit claims. Bego is seeking actual damages and civil penalties.

Kimberly Toler claims the defendants exposed Mark Toler to illegal and unsafe levels of respirable dust and, as a result, he suffered complicated pneumoconiosis and was awaiting a double lung transplant at the time of his death. Kimberly Toler is seeking compensatory and punitive damages with pre- and post-judgment interest.

* The Nulls claim the 61 defendants caused Robert Null’s asbestosis. They are seeking a jury trial to resolve all issues involved.

Jerry Roat and Lisa Roat vs. Johnson & Johnson; Janssen Pharmaceuticals, Inc.; and Ortho-McNeil Pharmaceuticals, Inc.

* On Feb. 11, 2011, Jerry Roat sought treatment from Montgomery General Hospital and Dr. Paul Edward Jackson with complaints of congestion, fever and severe sweating. A chest X-ray was performed, which showed no acute pulmonary infiltrate, and Jerry Roat was given Levaquin 500mg and discharged, the suit says. Two days later, Jerry Roat returned with complaints of shortness of breath, cough, fever, light-headedness and dizziness. The Roats claim another chest X-ray showed changes in Jerry Roat’s lung and he was placed on oxygen and transferred to Beckley ARH Hospital with a diagnosis of pneumonia, respiratory failure and ARDS. Jerry Roat was continued on Levaquin and his condition worsened and he was transferred on Feb. 17, 2011, to Charleston Area Medical Center, the suit says. The Roats claim Levaquin caused him to develop ARDS and subsequent multiple organ failure. The Roats are seeking compensatory and punitive damages with pre- and post-judgment interest.
