CHARLESTON – A Matewan man is suing 55 companies he claims are responsible for his lung injury.
On March 17, Charles William Dawson was diagnosed with asbestosis, according to a complaint filed Feb. 12 in Kanawha Circuit Court.
Dawson claims the defendants exposed him to asbestos and/or asbestos-containing products during his employment at various job sites in West Virginia from 1960 until 2010.
Dawson claims he is a life-long non-smoker.
The defendants are being sued based on theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentation and post-sale duty to warn, according to the suit.
Dawson is seeking a jury trial to resolve all issues involved. He is being represented by Bronwyn I. Rinehart of James F. Humphreys & Associates.
The case has been assigned to a visiting judge.
The 55 defendants named in the suit include 3M Company; Aleris International, Inc.; A.W. Chesterton Company; Borg-Warner Corporation; Brand Insulations, Inc.; CBS Corporation; Certainteed Corporation; Cleaver Brooks Company; Columbus McKinnon Corporation; and Copes-Vulcan, Inc.
